A grandmother of seven from Nunthorpe near Middlesbrough is likely to receive £150,000 in personal injury compensation after suing the driver of a company van who reversed into her on the pavement and crushing her.
Mary Kitchings or Guisborough Road received internal injuries when you was crushed underneath the van in September 2008. Her pelvis was fractured along with her hip, rib and spine and also recevied other internal injuries.
Mrs Kitching's – a former dance teacher - went on to spend 6 weeks in intensive care followed by 4 months in a ward in Middlesbrough’s James Cook University Hospital, where doctors had initially given her little chance of survival.
Now, after three agonising years of recovery, she has been told to expect £150,000 in compensation.
Speaking on the incident, Mrs Kitching’s said “the van was behind me out of my sight and it reversed towards me and threw me on the road.
“He hit me from the side with a sickening impact and drove over me. I hammered on the van’s underneath with my hands and feet to try to make him stop.”
Mrs Kitching’s solicitors have now settled on “substantial” damages from Transit van driver Anthony Robinson and his employers Ultralux Window Systems, of Eaglescliffe.
She was standing on the pavement outside a pizza shop in Guisborough Road, Nunthorpe, when she was hit by the van which knocked her over and halted on top of her, according to a High Court writ issued by her personal injury solicitor.
Mr Robinson, of Leven Road, Yarm, was later convicted at Langbaurgh East Magistrates Court of driving without due care and attention, he was given nine penalty points on his licence and fined £340, with £65 costs.
Mrs Kitching has needed high levels of care during her recovery and still needs help with day-to-day activities and finds walking difficult.
